Social Media – The New Focus Group for Certified Legal Nurse Consultants

Attorneys litigating high profile and high dollar cases have long used pretrial focus groups to help shape their themes, strategies and trial presentations. With the advent of social media, focus groups can now take on a whole new format using Twitter®, Facebook® and the blogosphere as free focus groups.

After the Casey Anthony criminal trial, Amy Singer, the chief defense trial consultant stated “Social media was the difference between winning and losing.” Prior to and during trial, Singer’s company monitored some 40,000 blogs, chat rooms and Facebook® pages to find out what people were thinking about the case and her defense attorney used that information to help shape his trial strategy. Did it work? Apparently.

It’s easy to think about including social media in high profile trials like Casey Anthony’s or Michael Jackson’s doctor, Conrad Murray. You should also think about using it to gauge public perception of the acts of a defendant-manufacturer who failed to warn of a popular prescription drug’s side effects or to disclose a product defect. It can also be used in toxic tort cases such as those against British Petroleum involving the Deepwater Horizon oil spill.

As Certified Legal Nurse Consultants become involved in more and more high profile cases social media will play an important role. When relevant, you or your attorney-client’s staff can monitor all the different social media outlets to see what the population, and possibly the potential jury pool, is thinking. Pre-trial sleuthing may help your attorney-clients to shape their strategy. Sleuthing during the trial itself can keep a pulse on how they’re doing and what they need to do differently.

I don’t want to see the future shaped by a Google search result, but this is one case where it just might be.
